1. General use conditions

The present General Terms of Use expressly regulate the commercial relations between the brand SELAFANO, legally represented by the company ZENITH ABILITY UNIPESSOAL, LDA., NIPC 513538402, with its registered office at Centro Empresarial de Braga - Rua Professor Doutor Henrique Barros - Lote D2 - 4705-319 Braga, with a share capital of €1.00 and general contact email info@selafano.com, and all customers who purchase products through the online store on the website www.selafano.com.

It is reiterated that these terms apply exclusively to the online store and, therefore, do not extend to or bind Institutions. With regard to Institutions, their respective Terms of Use are independent and distinct from the present ones.

If you are a user of the Institutions, please refer to their respective Terms of Use.

We kindly request that you carefully read this document, as well as our Privacy Policy, before using our website.

The information or data provided by the user will be processed in accordance with our Privacy Policy. By using our website, you consent to the processing of such information and data and declare that all information or data you provide is accurate and truthful.

By using our website or placing an order through it, the user/customer acknowledges and agrees to comply with these terms and our Privacy Policy. Therefore, if you do not agree with any of our terms or our Privacy Policy, you should refrain from using our website.

ZENITH ABILITY UNIPESSOAL, LDA. reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.

These terms may be modified at any time. Therefore, it is your sole responsibility to review them periodically, as the terms in effect at the time of your use of our website or the purchase of products shall be the ones applicable.

2. Customer/User obligations

By using our website and/or placing orders through it, the user/customer agrees to:

– Use our website appropriately, in accordance with the law and other applicable regulations, as well as principles of decency, good practices, and customary standards when purchasing our products and using other services available on our website.

– Refrain from placing any false or fraudulent orders, as well as from using the website improperly or in a harmful manner, including any actions that may disrupt the proper functioning of our online store. Such conduct may hinder legitimate access and use by other customers/users and could cause significant damage to the property or rights of ZENITH ABILITY UNIPESSOAL, LDA., its suppliers, customers/users, or, in certain cases, third parties.

– Provide the requested information (such as email address, postal address, and/or other contact details) accurately and truthfully, as failure to do so may prevent us from processing your request or order.

– Ensure that access to our website and the materials available on it is lawful in the jurisdiction from which you access or view the website or its content.

– Declare, when placing an order through our website, that you are at least 16 years old and have the legal capacity to enter into contracts.

Our website is intended for adults; therefore, individuals under the age of 16 should not use it. If the user is 16 years or older but has not yet reached the age of majority in their jurisdiction of residence, their legal guardian must use the website on their behalf, and the user should not access it independently or provide any personal information. ZENITH ABILITY UNIPESSOAL, LDA. does not knowingly collect information from users under the age of 16.

3. Products and prices

3.1 – ZENITH ABILITY UNIPESSOAL, LDA. reserves the right to modify, at any time, the selection of products and other services available on our website.

Likewise, at any time and without prior notice, new products or services may be added, or the provision or accessibility of any category of products and services offered on the website may be discontinued.

Unless otherwise stated, new products and services will be subject to these General Terms and Conditions.

3.2 – The presentation and display of products and services on our website aim to replicate the originals as accurately as possible, considering the limitations of technology and internet display. The characteristics and pricing of products and services are published on our website.

3.3 – The price of each product shall be as stated on our website at any given time, except in cases of obvious error.

Although we strive to ensure that all prices displayed on the website are accurate, errors may occur. If we detect an error in the price of a product you have ordered, we will inform you as soon as possible and offer you the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be canceled, and you will receive a full refund of any amounts paid.

We are under no obligation to supply any product at an incorrect price (even if we have sent the Shipping Confirmation) if the pricing error is evident and unmistakable and could reasonably have been recognized by the customer as an incorrect price.

3.4 – The prices displayed on our website are in euros and include the applicable Portuguese Value Added Tax (VAT), unless otherwise indicated.

Please note: Shipping costs are not included in the product prices. These will be detailed at checkout before completing the order.

3.5 – Product prices may be modified at any time; however, such changes will not affect orders for which an order confirmation has already been sent.

3.6 – All orders are subject to product availability.

If the desired product is out of stock, we will notify you immediately of its unavailability. In such cases, you may provide your email address to receive a notification if and when the product is restocked.

4. Order Process and Payment Methods

4.1 – After adding the desired items to your shopping cart, you must complete the order process. To do so, proceed with the purchase by clicking on "Checkout" and then filling in or verifying the required information at each step.

Next, you should select your preferred payment method from the available options and proceed with the corresponding payment.

Finally, click on "Complete Purchase."

4.2 – Payment Methods:

Credit Card and MB Way: By using these payment methods, you are immediately entering into a purchase and sale contract with us.

Multibanco: After clicking "Complete Purchase," you will receive an entity and reference number along with the order amount. You have four (4) days from the time of placing your order to make the payment; otherwise, the order will be canceled. By completing the payment, you are entering into a purchase and sale contract with us.

Bank Transfer: After clicking "Complete Purchase," you will receive details regarding the order amount and number, as well as the bank account information for ZENITH ABILITY UNIPESSOAL, LDA., with the IBAN: PT50 0007 0000 0046 4547 1632 3, where the payment should be made. You will also receive our treasury email tesouraria@selafano.com.

You have 5 (five) days from the time of placing your order to complete the payment; otherwise, the order will be canceled. Additionally, you must send us proof of payment, including the corresponding order number, to tesouraria@selafano.com By doing so, you are entering into a purchase and sale contract with us.

4.3 – If you have a voucher, you must enter it before clicking "Checkout."

4.4 – Once the payment has been processed, the customer will receive an email confirmation of the order at the email address provided.

 

After payment is completed, the order cannot be canceled. However, you may exchange or return items in accordance with the terms outlined below, though we do not assume responsibility for any associated shipping costs.

4.5 – The purchase confirmation sent by our website does not serve as an invoice but only as proof of purchase. ZENITH ABILITY UNIPESSOAL, LDA. will provide the invoice upon delivery of the order.

4.6 – Once your order has been processed, you will receive an email notification at the provided email address confirming that your order has been shipped.

4.7 – If you do not receive your order, if you receive the wrong size or item, if any item is missing from your order, or if you receive a defective product, please contact us at apoioaocliente@selafano.com.

4.8 – Our website allows purchases to be made as a guest, meaning you do not need to create an account to place an order.

In this mode, after adding items to your shopping cart, you may select "Guest Checkout." In this case, only the essential information required to process your order will be requested.

5. Exchanges and Returns

5.1 – The customer, as a consumer, has the right to withdraw from the purchase and sale contract within 14 calendar days, without the need to provide any reason.
The withdrawal period expires 14 days from the day following the date on which the customer or a third party designated by the customer, other than the carrier, acquires physical possession of the ordered items.

To exercise the right of withdrawal, the customer must communicate their decision to withdraw from the contract to ZENITH ABILITY UNIPESSOAL, LDA., headquartered at Centro Empresarial de Braga - Rua Professor Doutor Henrique Barros - Lote D2 - 4705-319 Braga, by email at apoioaocliente@selafano.com or by phone at +351 253 277 102, available from Monday to Friday from 09:00 to 12:00 and 14:00 to 17:00. This must be done through an unequivocal statement (for example, by registered letter or email).
The customer may also use the withdrawal form template provided in the annex to this document, but its use is not mandatory.

To comply with the withdrawal deadline, it is sufficient that the communication regarding the exercise of the right of withdrawal is sent before the withdrawal period expires.

In the event of contract withdrawal, the amount paid for the items will be refunded without undue delay, within 14 days from the date on which we are informed of the decision to withdraw from the contract.
The refund will be issued via bank transfer to the account indicated by the customer. We may withhold the refund until we receive the returned goods or until the customer provides proof of their return, whichever occurs first.

The customer must return the items within 14 days from the date of communication of the withdrawal decision, sending them to:

The customer shall bear the cost of returning the goods.
The return of items may be carried out using any delivery method chosen by the customer.

The customer must keep the goods in a manner that allows them to be returned in proper condition for use. Please note that once the order has been delivered, if the customer exercises the right of withdrawal and returns the goods, they assume responsibility for the contents of the return package. We do not accept liability for any risks associated with the return package.

At the time of return, the items must be in the same condition in which they were received. No refund will be issued if the product has been used beyond the simple opening of its packaging or if it has suffered any damage.
The withdrawal deadline is considered met if the customer returns the products before the 14-day period expires.

5.2 – In addition to the legally recognized right of withdrawal, as stated above, the customer has the right to return any item, provided that it remains in its original packaging, unused, and accompanied by the purchase receipt, except in cases where the item has been customized, such as embroidery, printing, or other permanent markings, specific colors, or fittings requested by the customer.

In such cases, ZENITH ABILITY UNIPESSOAL, LDA. will only accept a return if there is a manufacturing defect or a production error.

The customer has a period of 30 (thirty) days from the date of receipt of the order to request a return or exchange of the purchased item.

The items must be returned in the same condition in which they were received. Please note that no refund will be issued if the product has been used beyond the simple opening of its packaging or if it has suffered any damage. Therefore, the customer must handle the products with care while they remain in their possession.

The customer must notify us of their intention to return or exchange a product by sending an email to apoioaocliente@selafano.com, including the order number and details of the item to be returned or exchanged.
Once this request has been received, the customer will receive an email confirmation regarding the return or exchange.

The return must be made within 30 (thirty) days from the date of shipment confirmation.

The customer is responsible for the costs of returning or exchanging the items and may choose the shipping method. It is strongly recommended that the customer retains proof of shipment, as ZENITH ABILITY UNIPESSOAL, LDA. declines any responsibility for loss or damage occurring during the return/exchange transportation process.

The return entails the refund of the amount paid by the customer, minus shipping fees, payment processing fees, or other expenses not directly related to the item.

The refund will be processed after the returned item has been examined, via bank transfer to the account indicated by the customer, within 30 (thirty) business days.

A confirmation email will be sent once the refund has been completed.

If more than 30 (thirty) days have passed and the customer has not received the refund, they should present the refund confirmation to their bank to facilitate the process.

5.3 – If the customer finds that, at the time of delivery, a product does not comply with the terms of the contract, they must contact us via email at apoioaocliente@selafano.com or by phone at +351 253 277 102, available from Monday to Friday from 09:00 to 12:00 and 14:00 to 17:00, within 30 (thirty) days, specifying the defects found in the product.

Once the item has been returned, it will be inspected by the relevant department.

If a defect is confirmed, the customer may choose either a replacement of the product or contract termination.

In the case of contract termination, all amounts paid for the defective products will be fully refunded, including the original shipping costs and any return shipping costs incurred by the customer.

In the case of a replacement, a new item will be sent, and the costs incurred for returning the defective item will be refunded.

The replacement or refund will be processed as soon as possible and, in any case, within a maximum of 30 (thirty) business days.

The refund will be made via bank transfer to the account indicated by the customer.

6. Shipping and Order Delivery

6.1 – The geographic scope of sales through our website is limited to mainland Portugal, meaning that the delivery service is only available within this area.

Orders shipped to the Azores and Madeira are subject to a maximum weight limit of 4 kg per order.

Shipping to Spain, Germany, Austria, Belgium, Croatia, Denmark, Slovakia, Slovenia, Estonia, France, Finland, Greece, the Netherlands, Hungary, Ireland, Italy, Latvia, Luxembourg, Lithuania, Monaco, Poland, the Czech Republic, Romania, Sweden, and Ukraine is subject to a maximum weight limit of 10 kg per order.
For shipments to other countries, delivery availability and conditions must be confirmed upon request

6.2 – Orders will be shipped to the postal address provided at the time of purchase, once payment has been confirmed.
After payment has been processed and the order has been received, it will not be possible to modify the shipping address for that order

6.3 – Orders will not be accepted if the delivery address is a non-permanent location, such as P.O. boxes, tourist accommodations, or similar temporary addresses.

6.4 – Orders are processed as quickly as possible and always within a maximum period of 30 (thirty) days from the day following the contract's conclusion.

If the contract cannot be fulfilled due to the unavailability of the ordered item, we will notify the customer via email and issue a full refund of the amount paid, within a maximum period of 30 (thirty) days from the date we became aware of the unavailability.

6.5 – The delivery service is carried out by reputable logistics partners, such as DPD, with an estimated delivery time of 4 to 6 business days.

6.6 – Shipping costs are not included in the item price.
Before finalizing the order, specifically in the order summary section, the customer will be informed of the applicable shipping fees, which will be added to the total amount of the order.

The total order price will be determined by the sum of the item prices and the applicable shipping fees.

7. Customer Support Service

8. Intellectual and Industrial Property

8.1 – The user/customer acknowledges and agrees that all copyrights, trademarks, and other intellectual and industrial property rights over the materials and content provided as part of our website—including each article, information, and materials contained therein (such as trademarks, structure, selection, and organization of content, software for the operation of the online store)—are at all times the exclusive property of ZENITH ABILITY UNIPESSOAL, LDA., SELAFANO, or the licensors who have granted us the right to use them.

8.2 – It is strictly prohibited to reproduce, alter, modify, conduct any form of malicious engineering, distribute, rent, lend, or enable public access through any means of public communication to all the aforementioned items, except when expressly authorized by ZENITH ABILITY UNIPESSOAL, LDA. or the corresponding rights holders, and in accordance with the legally permitted rights of the user/customer.

The user/customer may only use the information, services, and all articles available through the online store for personal use. It is strictly forbidden to make any commercial use, whether directly or indirectly, of the information, services, articles, or any other elements obtained through the online store.

8.3 – The user/customer is not permitted to bypass or manipulate any of the technical security measures that are part of the online store and belong to ZENITH ABILITY UNIPESSOAL, LDA., SELAFANO, or third parties.

9. Data Protection

9.1 – In compliance with the National Personal Data Protection Law (Law No. 58/2019, of August 8) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016), we inform you that all personal data and other information contained in the registration form, as well as those arising from commercial transactions, will be stored in a file owned by ZENITH ABILITY UNIPESSOAL, LDA., until its deletion is requested.

The processing of personal data is intended for the execution of commercial transactions, as well as for enhancing our promotional services, aiming at a better dissemination of both our services and products, as well as those of companies associated with ZENITH ABILITY UNIPESSOAL, LDA., always striving for customer satisfaction.

ZENITH ABILITY UNIPESSOAL, LDA. will maintain strict confidentiality of this data, and it will not be disclosed to third parties, except under the conditions stated in these General Terms and Conditions and the Privacy Policy, or in accordance with applicable laws and regulations.

9.2 – The user/customer may, at any time, access their account to rectify, update, or request the deletion of their data.

9.3 – When filling out the registration form, all fields marked with an asterisk (*) are mandatory. Failure to fill in these fields will prevent successful registration.

10. Cookies

10.1 – Our website uses Cookies to improve its services, facilitate navigation, ensure security, verify the identity of the user/customer, and personalize user preferences. Cookies are files installed on the hard drive of a computer, in the browser’s memory, or in a designated system folder of the user’s device for identification purposes.

10.2 – If the user/customer does not wish to allow the installation of Cookies, they must configure their internet browser accordingly. The user/customer may delete Cookies at any time.

However, disabling Cookies may affect service quality and speed and could even result in the loss of access to certain features available on our e-commerce platform.

11. Links From our Website

If our website contains links to third-party websites or materials, these links are provided solely for informational purposes. We have no control over the content of such websites or materials.

Therefore, we do not accept any liability for any damages or losses incurred as a result of their use.

12. Miscellaneous

12.1 – The use of our website and these General Terms and Conditions are governed by portuguese law.

12.2 – In the event of a dispute, the competent court is the Judicial Court of the District of Braga.

Additionally, consumers have the right to attempt an out-of-court resolution of disputes related to product purchases through arbitration courts (Alternative Dispute Resolution Centers).

The competent arbitration court is that of the consumer's place of residence.
